The Paper calls for a streamlining of the law relating to adult social care which is spread across 38 Acts of Parliament and hundreds of statutory instruments.
Keith Lewin, Senior Partner at Brunswicks, says:
“The Law Commission’s Paper is thoughtful and makes a number of helpful recommendations, particularly on the aspect of safeguarding adults at risk of abuse, key to the recommendations is to put safeguarding boards on a statutory footing.”
Lewin goes on to say:
“The proposal that legislation should place a duty on each social services authority to establish an adult safeguarding board and specifying the functions and membership of the board is to be welcomed. At the moment every authority has its own, different, policy and whether key voices, particularly those of the care providers, are heard is something of a lottery and in many cases safeguarding boards currently seek ambush providers.”
